Terms of Service

These Terms of Service (“Terms”) govern your use of hawaiivendors.com (the “Service”), operated by Lokal Media LLC (d/b/a Hawaii Vendors). By using the Service you agree to these Terms.

Eligibility & accounts

You must be at least 18 years old to create an account or submit an inquiry through the Service. You are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity under your account. We may suspend or terminate any account that violates these Terms, and you may close your account at any time.

By creating an account or using the Service, you consent to receive communications from us electronically — such as account, transactional, and service emails, and (for business accounts) messages delivered to your dashboard with an email notification. Marketing emails include an unsubscribe link.

Business listings & payment

Paid vendor and venue listings are governed by our Terms of Advertising, accepted at checkout. In summary:

• Listings are sold as annual subscriptions, paid by card through our third-party payment processor. Subscriptions renew automatically each year until cancelled; we email a reminder before each renewal.
• You can cancel anytime from the billing portal in your dashboard or by contacting us; your listing stays live through the end of the paid term. Fees already paid are non-refundable except where required by law.
• New listings are reviewed by our team before going live. We may decline or remove listings that violate these Terms.
• You are responsible for the content of your listing and must have the rights to any text and images you upload.

The Service is a directory — we do not vet vendors

Hawaii Vendors is an advertising directory that helps couples discover and contact independent wedding vendors and venues. We are not a wedding planner, agent, broker, or party to any agreement, booking, or transaction between a couple and a vendor.

We do not screen, vet, background-check, endorse, or guarantee any vendor or venue, or their licensing, insurance, pricing, availability, quality, or conduct. Listings are provided by the businesses themselves (or, for imported “curated” listings, from public sources), and we do not guarantee that any listing information is accurate or current. Any decision to contact, hire, or pay a vendor is yours alone, and you should do your own due diligence. To the fullest extent permitted by law, we are not responsible or liable for the acts, omissions, services, products, cancellations, no-shows, refunds, or disputes of any vendor, couple, or other user, or for the outcome of any inquiry or booking.

Imported (“curated”) listings

Some listings are created by us from publicly available sources for businesses that have not signed up, so couples can still discover them. These listings show basic public information only. If your business appears in a curated listing, you may claim it, request corrections, or ask us to remove it by contacting us at info@hawaiivendors.com — we will honor reasonable removal requests.

Inquiries & messaging

The Service lets couples send inquiries and quote requests to vendors and exchange messages with them. When you submit an inquiry — including a multi-vendor quote request — you authorize us to share your contact and wedding details with the vendor(s) you selected or that match your request so they can respond (see our Privacy Policy). You agree to provide accurate information and to use inquiries and messaging only for genuine wedding-related purposes. We relay messages between couples and vendors as a convenience and do not undertake to monitor them — though we may access and review messages sent through the Service where reasonably needed for support, security, moderation, or legal compliance — and we do not verify or take responsibility for the content of those communications or for how a vendor or couple uses information shared through them.

The Service also includes a messaging feature between business account holders and the Hawaii Vendors team. Messages sent there go to our team, and we may retain and use them to provide support, keep records, and operate the Service.

Acceptable use

You agree not to, and not to allow anyone else to:

• submit false, misleading, unlawful, or infringing content;
• scrape, crawl, harvest, or collect contact information or other data from the Service, or access it by automated means, without our written permission;
• use inquiries, listings, messages, or any contact information obtained through the Service to send spam or unsolicited marketing, or for any purpose unrelated to a genuine wedding inquiry;
• resell, sublicense, or commercially exploit the Service or its data;
• impersonate anyone, or attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service.

We may investigate and take appropriate action for any violation, including removing content and suspending or terminating accounts.

Intellectual property & your content

The Service and its branding are owned by Lokal Media LLC (d/b/a Hawaii Vendors). You retain ownership of the content you submit (listing content, photos, inquiries, messages), but you grant us a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and adapt that content as needed to operate and promote the Service. You represent that you have the rights to any content you submit and that it does not violate any law or third-party right. You are solely responsible for your content.

Disclaimers

The Service is provided “as is” without warranties of any kind. We do not warrant that listings are accurate or that the Service will be uninterrupted or error-free.

Limitation of liability

To the maximum extent permitted by law, Lokal Media LLC (d/b/a Hawaii Vendors) and its owners and representatives will not be liable for any indirect, incidental, special, or consequential damages, or any lost profits, lost data, or lost business, arising out of or relating to the Service or any dealings between couples and vendors, even if advised of the possibility of such damages. For couples and other users who do not pay us a fee, our total liability for any claim relating to the Service will not exceed one hundred U.S. dollars ($100). (A paying advertiser’s liability cap is set in the Terms of Advertising.)

Indemnification

You agree to defend, indemnify, and hold harmless Lokal Media LLC (d/b/a Hawaii Vendors) and its owners and representatives from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your content, your use of the Service, your dealings with any vendor or couple, or your breach of these Terms.

Governing law

These Terms are governed by the laws of the State of Hawaii, without regard to conflict-of-law rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in the State of Hawaii for any dispute arising out of or relating to these Terms or the Service.

Changes

We may update these Terms from time to time. We will post the updated version here with a new date, and continued use after changes take effect constitutes acceptance.

General

These Terms, together with our Privacy Policy (and, for paid advertisers, the Terms of Advertising), are the entire agreement between you and us regarding the Service and supersede any prior understanding. If any provision is found unenforceable, the rest remains in effect. You may not assign these Terms without our consent; we may assign them, including in connection with a sale or transfer of the business. Our failure to enforce any provision is not a waiver of it.
